General Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. By accessing or using the Altura platform, you agree to be bound by the terms set forth herein. If you do not agree with any part of these terms, please do not use our services.

These General Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you", "your", "user", or "Customer") and Altura Financial Services Limited, a Non-Banking Financial Company (NBFC) registered with the Reserve Bank of India (RBI) (hereinafter referred to as "Altura", "Company", "we", "us", or "our"), governing your access to and use of the lending platform (the “Platform”) to avail financial products or services, either directly from Altura or through a Lending Service Provider (LSP) or any third-party technology service provider facilitating such access.

These Terms are published in compliance with and are governed by the provisions of applicable Indian laws, including but not limited to:

  • The Indian Contract Act, 1872
  • The Information Technology Act, 2000 and allied rules
  • The Reserve Bank of India Act, 1934
  • RBI Master Directions and Guidelines for Non-Banking Financial Companies
  • RBI Guidelines on Digital Lending issued on September 2, 2022 and as amended from time to time

1. Definitions

  • Altura/Company/We/Us: Altura Financial Services Limited, a company incorporated under the Companies Act, 2013 and registered as an NBFC with the Reserve Bank of India.
  • User/Customer/You: Any natural person who visits, accesses, or uses the Platform or avails any product or service facilitated by Altura or its authorized partners.
  • Platform: Any digital or physical interface (including websites, mobile applications, kiosks, or physical branches) owned and operated by Altura, or operated on its behalf by a third-party Lending Service Provider (LSP) or technology services provider.
  • LSP: A third-party technology or service provider that acts as a facilitator between the user and Altura for offering loan products, as per RBI guidelines.
  • Loan Agreement: A legally binding agreement executed between the Customer and Altura in relation to the financial product or credit facility sanctioned to the Customer.

2. Eligibility Criteria

By accessing or using the Platform, you confirm that:

  • You are a resident Indian citizen;
  • You are at least 18 years of age;
  • You are of sound mind and competent to contract under Indian laws;
  • You are using the Platform solely for lawful purposes; and
  • You are not barred or restricted by any applicable law or regulatory authority from accessing financial services.

Altura reserves the right to deny or suspend access to any user not meeting the above criteria or found violating these Terms.

3. Nature of Services

Altura offers credit and loan products either directly through its own Platform or through a Lending Service Provider (LSP) engaged to facilitate such services via a digital or physical interface. The Platform enables:

  • Loan origination and onboarding;
  • KYC and credit evaluation;
  • Loan disbursement and servicing;
  • Customer support and grievance redressal.

Altura remains the sole lender and is fully responsible for approving or rejecting loan applications and determining terms of credit. All decisions are based on Altura’s internal credit policy, due diligence processes, and applicable regulatory guidelines.

Note: The LSP or technology provider facilitating access to the Platform does not provide loans and acts merely as an intermediary.

4. User Information and Consent

By using the Platform, you consent to:

  • Furnish accurate and complete personal, financial, and professional details;
  • Provide valid KYC documents and verify identity through permitted digital means;
  • Authorize Altura and/or its authorized service providers to access your credit reports from credit bureaus;
  • Permit sharing of your data with credit bureaus, third-party verification agencies, and regulatory authorities.

You acknowledge that failure to provide correct and updated information may result in denial or termination of services.

5. Loan Application, Disbursal, and Agreement

  • Your loan application will be processed in accordance with Altura’s internal credit policies and applicable laws.
  • If approved, you will receive a Key Fact Statement (KFS), sanction letter, and a Loan Agreement, detailing the terms of the loan including interest rate, tenure, EMI amount, fees, and charges.
  • Disbursal of the loan amount will be made directly into your bank account.
  • A Digital Loan Agreement will be executed between you and Altura. You are advised to carefully read and understand the agreement before accepting it.

Altura retains the right to cancel or revoke a loan offer prior to disbursement without assigning any reason.

6. Use of Platform

You agree to use the Platform only for its intended purposes and in compliance with these Terms. You undertake not to:

  • Use the Platform for any unlawful, abusive, or fraudulent activity;
  • Misrepresent or falsify your identity, documents, or information;
  • Tamper with or gain unauthorized access to the Platform or data;
  • Upload or transmit any viruses, malware, or harmful content.

Altura shall not be liable for unavailability of the Platform due to maintenance, technical issues, or force majeure events.

7. Fees and Charges

All applicable fees, charges, interest, penalties, and taxes will be disclosed in the Loan Agreement and Key Fact Statement (KFS). You are responsible for reviewing and accepting the cost of borrowing prior to disbursal.

No hidden charges will be levied, and all fees will be communicated upfront in a transparent manner.

8. Data Protection and Privacy

Altura is committed to safeguarding your personal and financial data in accordance with the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023 (DPDP Act).

Your data will be:

  • Collected and processed lawfully, fairly, and transparently;
  • Retained only as long as necessary for providing services or as required by law;
  • Shared only with authorized entities and for legitimate purposes.

9. Limitation of Liability

Altura shall not be liable for any:

  • Indirect, consequential, or incidental damages;
  • Delays or failures caused by force majeure or third-party disruptions;
  • Unauthorized access to user data resulting from user negligence;
  • Losses due to disputes between the user and any third-party including LSPs.

The Platform and services are provided on an “as-is” and “as-available” basis without warranties of any kind.

10. Amendments

Altura reserves the right to revise these Terms at any time. Updated Terms will be published on the Platform with the revised effective date. Continued use of the Platform after changes implies your acceptance of the modified Terms.

11. Termination

Altura may suspend or terminate your access to the Platform or services if:

  • You breach these Terms;
  • Engage in unlawful or fraudulent behaviour;
  • Misuse the Platform or violate loan terms.

Any obligations or liabilities incurred prior to termination shall survive and remain enforceable.

12. Dispute Resolution and Jurisdiction

All disputes arising under or in connection with these Terms shall be governed by Indian laws and subject to the exclusive jurisdiction of competent courts in Delhi, India.
